I'm working on my will and the executor lives in MA, as does 99% of my family. From what I've read, The executor takes immediate possession of NFA stuff until any transfers are approved. That isn't an option because silencers are illegal in MA and my SBR is post ban in no-ban configuration. My plan is to leave the NFA stuff to a friend here in NH. Can I arrange to have a dealer sit on them until the transfers go through? They are in my name, not a trust. Would a trust make this easier?

If I leave some of the Title 1 stuff to family in MA, does it need to go through a dealer? That is important because most of my pistols are not on the "Approved handgun list". They are legal to possess in MA and you can bring them with you if you move there. However, a dealer is not allowed to transfer them to a non-LEO within the state. If they must go to a dealer, then they cannot be left to MA residents.

Yes, I realize that I must leave clear instructions about which mags can be brought into MA.

I created and teach a MA Gun Laws seminar that goes into great detail about this stuff as there is much confusion and mis-information out there. [NOTE: I deleted the NFA stuff as I have no real knowledge of those laws, I am a SME on "conventional guns" MA gun law.]

No FFL is required. Most PDs will advise next of kin to use an FFL . . . if they do that, most handguns are "dead in the water" and can't be transferred to anyone in MA!

I taught the seminar at Manchester Firing Line last October and expect to do so again "sometime" in 2012, but MFL will be ripping apart and renovating the old range (where the classroom is located), so I'm awaiting info from Carey. If the executor lives in E. MA it might pay for that person to attend a seminar to understand all the intricacies as well.

Thanks Len. Will you be posting the schedule in the NEHTF when your seminars start up again?

It is good to know that I can leave my non-compliant pistols to family in MA.

Eric,

The answer is yes, but I have to put everything together for a single post (I'm also running some NRA courses over the next few months as well). ARfcom has changed some rules and allowed approved Instructors to post a single thread/month in their HTF listing all their training being offered.
