 M203 Registered DD and Title 1 Receiver...can I have a spare 40mm barrel in my possession?

I have an LMT M203 registered DD 40mm w/ 9inch barrel. If I buy a parts kit for another receiver which is an ORF title one receiver - is it legal to build this receiver with a spare 40mm barrel in my possession? I don't mean putting my spare 40mm barrel on my title one receiver but, just having it in my possession. What if I don't have a 37 mm barrel yet?

Will the ORF receiver fit parts kit? I have heard that the quality of their receivers aren't the best.

You need to have a legal way to assemble the Title 1 Reciever, if you have 2 40mm barrels, and no 37, you don't..
I'd say get a 37mm barrel first, then you'd be good to go.

isnt that the same thing as having one SBR AR15 and many SBR uppers along with anorher non SBR AR15 lower?

I'm sure its better to just have a 37mm barrel on it just in case.

I think that's what I said.

You need to have a 37mm barrel for the title 1 reciever, in order to have a legal way to assemble it.
Then get as many "spare" barrels for the Title II reciever as you like.

The Title I receiver can remain stripped as long as you also have a registered 40mm M203. The registered DD M203 is your path to legality for any spare 40mm barrels in your possession.

Constructive Possession does not require you to actually assemble the parts into a complete and legal firearm, you merely need a legal use for the parts in question, which you do with the registered DD M203.

CP does not require a legal way to assemble the receiver, it requires a legal pathway for the use of the NFA part or parts that are in the presence of the compatible Title I firearm. Big difference.

In this case there is a complete M203 that is registered as a DD, then there is a complete M203 parts kit including a 40mm barrel (NFA), which is considered a legal spare part for the registered DD M203, thus establishing your pathway for legal use. The Title I M203 receiver has no CP issue here since the spare 40mm barrel legally associated with the registered DD.

so as long as I have a RDD I can have all the spare 40mm parts I want with a title one receiver

Exactly. Just make sure nothing 40mm is ever installed on the Title I M203 receiver.
