Stripped lowers in NJ? Now with follow up question!
A buddy of mine wants to build an AR.
Are they gtg with a FID?
New Jersey, how does it work?
If he`s a PRNJ resident, then the short answer is yes.

He is. Moved from KY a couple years ago and wasn't sure of the law in New Germany.

There is a gun show at Oaks PA next weekend.
If he buys a stripped lower in PA, does it need to be transferred to a NJ FFL? Or can he just walk with it like a long gun?
Due to the fact that stripped lowers now go on the 4473 as "other" it will need to through an in state FFL.

I tried to buy a stripped lower at a show in Allentown, PA and the dealer told me he could not sell it to me because I could make it into a pistol, but could sell me a complete AR, I posted this in the PA forum and was told this is correct, I think you need a pistol permit to buy a lower in PA

No, you don't need a pistol permit, and it has nothing to do with NJ law. It's federal law. Recently, bare receivers were reclassified as an "other" type of firearm (not a rifle, not a shotgun, not a pistol). According to federal law, FFLs may only transfer RIFLES and SHOTGUNS to out-of-state residents. Since a receiver is now an "other", it can not be transferred from FFL to non-FFL unless the non-FFL resides in the same state as the FFL.
You can buy all the stripped lowers you want in other states, but, just like a handgun, you have to have it shipped to an FFL here in NJ to transfer it to you.

Only long guns may be acquired out of state and it must be from a dealer. Receivers, handguns, and unfinished lowers (no excise tax paid) must go through a dealer in the buyer's state of residence.

If you buy a stripped lower with your FID and a COE, you can only build a long gun from it.
If you use a PPP to purchase it, you may (if you are magically able) to build a handgun from it, but unless you have an FFL and a NJ Dealer license, it better be Jersey-legal (<50 oz, etc) or you're going to get to be fast friends with Bubba and the Gang in the Big House!

Well, since he can't legally buy the stipped lower, the seller would have to assemble it into a rifle configuration first. Then, unless the seller had a type 7 FFL, he'd be guilty of unlawful manufacturing

What is a COE?
When I lived in NJ all I needed was a FID for long guns.
He has a FID.
COE is a Certificate of Eligibility and is required when a NJ FID holder acquires a long arm using his FID

Was told any AR was illegal and since the M44 had a bayonet it was illegal. Cop didn't care that the Mosin was a bolt action.
All charges were eventually dropped and all firearms returned. Took 18 months and 4K.
I think he got off easy.

The F'n prosecutors can't even figure out what the stupid laws are, let alone local officers that rely on the prosecutors office for training and clarification. Most of the time the idiots just respond with "take everything and let the courts figure it out." The answer here though, if its broken just add more confusion and less clarity, that'll fix it...

As far as stripped lowers go, i think you have the answer. Arent too many shops that will have em but i did find CMMG lowers at bullet hole in Bellville.

IMHO, it would be a more effective use of our donations if the NJ2A lawyers went after stuff like this, rather than suing for carry permits. Carry permits will never happen. However, a couple aggressive false arrest law suits could make the local PDs a little less cocky when it comes to abusing law-abiding gun owners.
