NY and what constitues a "machine gun".
Honest question;
Does NY have some extra factors in what constitutes a MG, on top of the federal guidelines? I've just never read into MG's and NY, since I know real MG's are plain no-go here.
I ask, because whenever the bump-fire stocks are brought up here in the NYHTF, people seem to be extra cautious about it. Meanwhile, if you read around elsewhere, people are buying and using these stocks all over the rest of the US without a care in the world.
Penal Law 265(1) defines machine gun.
Penal Law 265.02(2) sets forth the crime of possessing a weapon simulating a machine gun.
PL 265.00(1): "Machine-gun" means a weapon of any description, irrespective of size, by whatever name known, loaded or unloaded, from which a number of shots or bullets may be rapidly or automatically discharged from a magazine with one continuous pull of the trigger and includes a sub-machine gun.
So I guess belt-feds are good to go if it isn't designed to accept a magazine.

That's what I was looking for. Thanks. I can see why people are so cautious about these stocks in NY then.

So that means fingers must pull slower and no Pants/shorts belt loops?
simulating machine gun good look trying to convince a jury that your pulling the trigger very fast, semi autos oh no they are machine gunz!
